FORMR Trade Program — Terms & Conditions

By applying for, joining, purchasing through, or otherwise participating in the FORMR Trade Program, you acknowledge and agree to the following terms.

1. Confidentiality of Trade Information

All information provided to you as part of the FORMR Trade Program is confidential and is provided exclusively for the use of approved trade members.

This includes, but is not limited to:

  • Trade pricing, discounts and pricing structures

  • Quotes and project-specific pricing

  • Product information not publicly available

  • Plans, drawings, specifications and documentation

  • Trade policies, processes and program details

  • Supplier, production or sourcing information

  • Any other information identified or reasonably understood to be confidential or exclusive to the FORMR Trade Program

You agree not to disclose, distribute, reproduce, publish, forward or otherwise make this information available to any third party without the prior express written permission of FORMR.

Trade pricing and other confidential information must not be published online, shared on social media, provided to competing businesses, or otherwise made publicly available.

2. Intellectual Property

Unless otherwise agreed in writing, all concepts, drawings, plans, designs, specifications, documentation, imagery and other materials created by FORMR remain the intellectual property of FORMR to the extent permitted by applicable law.

Participation in the Trade Program, payment for a project, or receipt of FORMR materials does not grant permission to reproduce, modify, distribute or commercially use FORMR intellectual property beyond the purpose for which it was supplied, unless expressly agreed in writing.

3. Permission to Share Completed Work

By joining the FORMR Trade Program and engaging FORMR for a project, you grant FORMR permission to photograph, reproduce, publish and share material relating to work undertaken by FORMR for promotional, portfolio and marketing purposes.

This may include project photography, renders, drawings, plans, project details and other visual material relating to FORMR's work.

FORMR may use this material across its website, portfolio, social media, digital and printed marketing, presentations, editorial submissions and other promotional channels.

Where appropriate, this permission also extends to the use of a trade member's business name, brand name and logo in connection with the relevant project or trade relationship.

4. Opting Out of Marketing Use

If you do not consent to FORMR using your business name, logo, project plans, imagery or other project material for marketing or promotional purposes, this must be communicated to FORMR expressly in writing before payment is made and before work on the project is executed or commenced.

Any agreed restriction or exclusion must be confirmed by FORMR in writing to take effect.

If no written restriction has been provided and accepted before payment and commencement, you acknowledge that FORMR may rely on the permissions granted under these Terms.

5. Requests Made After Payment or Completion

Requests to withdraw marketing permission made after payment, commencement or completion of the project will not apply retrospectively.

Unless otherwise agreed by FORMR in writing, FORMR will not be required to remove, recall, delete or cease using material that has already been created, published, distributed, submitted, scheduled or incorporated into marketing or portfolio content in reliance on the permission provided under these Terms.

Any future change to marketing permissions will be at FORMR's discretion and must be agreed in writing.

6. Trade Program Acceptance

Participation in the FORMR Trade Program constitutes acceptance of these Terms.

By proceeding with a trade purchase, paying an invoice or engaging FORMR to undertake work under the Trade Program, you confirm that you have read, understood and agreed to these Terms, including the confidentiality obligations and permissions relating to the use of project material for FORMR's marketing and promotional purposes.
