Terms of Service

By placing an order with FORMR, you agree to the following Terms of Service.

1. Handmade Sculptures

Each sculpture is individually handmade with care and attention to detail. Due to the handmade nature of the work, small variations in colour, texture, finish, size, and detail may occur. These variations are part of the handmade process and are not considered faults or defects. Please remember to admire from the distance you would a painting or any other handmade piece. They are not made to be 100% perfect like you'd get from a fast homewares store.

2. Orders & Payment

A deposit or full payment is required before work begins. Your order is not confirmed until payment has been received. Deposits are applicable for orders over $3000 AUD on request.

Final payment, where applicable, must be received before the sculpture is shipped, delivered, or collected.

3. Turnaround Times

Sculptures take time to create properly. The process cannot be rushed without affecting quality.

If you have a deadline, you must inform us before placing your order or before we begin work on your sculpture. We will let you know whether your requested timeframe is possible.

4. Rush Orders

Rush orders may be accepted at our discretion only.

If a sculpture is completed under an expedited or rushed timeframe at the customer’s request, it is not covered by our standard workmanship warranty, except where required under Australian Consumer Law.

5. Customer Information & Reference Images

You are responsible for providing clear, accurate information, including reference photos, measurements, names, spelling, colours, and any special requests.

By providing photographs or reference images, you confirm that you have permission to use them and allow us to use them for the purpose of creating your sculpture.

6. Changes to Orders

Changes requested after work has begun may not always be possible.

If changes can be made, they may incur additional fees and may extend the completion timeframe. Once a design, detail, or progress stage has been approved, further changes may be treated as a new request.

7. Cancellations & Refunds

If you cancel your order before work has started, you may be eligible for a refund, excluding any non-refundable deposit or costs already incurred to secure our time.

If work has already begun, refunds are not guaranteed and will be assessed based on the time, labour, and materials already used.

Custom sculptures are made specifically for each customer and generally cannot be resold so please choose your preferences carefully.

8. Shipping, Delivery & Collection

Customers are responsible for providing the correct delivery address.

We take care to package sculptures safely; however, we are not responsible for courier or postal delays once the item has been dispatched.

If your sculpture arrives damaged, you must contact us as soon as possible with photographs of the damage and packaging so we can assess the issue and assist where appropriate.

9. Warranty

We stand behind the quality of our workmanship.

Our standard workmanship warranty does not cover:

  • Damage caused by mishandling, dropping, accidents, improper storage, or misuse.

  • Normal wear and tear.

  • Damage caused after delivery or collection.

  • Changes requested after completion.

  • Rush orders, except where required by Australian Consumer Law.

10. Respectful Communication

We are committed to respectful and professional communication and expect the same in return.

Abusive, threatening, harassing, aggressive, or disrespectful behaviour will not be tolerated.

If this occurs, we reserve the right to cancel your order. In this situation, you may be refunded for any work not yet completed, and the sculpture will not be provided.

11. Right to Refuse or Cancel Orders

We reserve the right to refuse or cancel an order at our discretion, including where the requested work is unsuitable, outside our capabilities, unable to be completed within the required timeframe, or where communication becomes inappropriate.

12. Photos & Portfolio Use

We may photograph completed sculptures and use these images on our website, social media, portfolio, or promotional materials.

If your sculpture is a private, sensitive, or memorial piece and you do not want images shared, please let us know in writing before completion.

13. Delays Outside Our Control

We are not responsible for delays caused by circumstances outside our reasonable control, including illness, supplier delays, courier delays, postal disruptions, severe weather, natural disasters, or other unexpected events.

14. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other rights that cannot legally be excluded.

15. Limitation of Liability

To the extent permitted by law, our liability is limited to the amount paid for the sculpture or the remedy required under Australian Consumer Law.

16. Agreement

By placing an order, you confirm that you have read, understood, and agreed to these Terms of Service.
